RS-1A zoning and permitted use

The lots are zoned RS-1A (Residential Single Family One - Tourist Accommodation) under Sun Peaks Zoning Bylaw No. 1400. The Information Statement identifies permitted uses that include a single-family dwelling, auxiliary buildings and uses, an auxiliary residential dwelling unit, home occupation, and tourist accommodation limited to one dwelling. Confirm the current bylaw and intended rental configuration before relying on a particular use.

Serviced lots with owner connection costs

Water, sanitary sewer, underground electrical, telecommunications conduit and underground piped propane services are provided to the lot boundaries. Owners are responsible for service connections, meters, applications and applicable hook-up or use fees.

Uphill and downhill home concepts

The available reference packages include concepts for both uphill-sloping and downhill-sloping properties. The downhill sample provides approximately 3,493 square feet of finished living space, while the uphill sample provides approximately 3,470 square feet. Both concepts include a main residence and a revenue basement suite.

  • Current lot status: confirm availability, price, dimensions, orientation and any property-specific conditions.
  • Legal documents: review the Information Statement, purchase agreement, title, Statutory Building Scheme, building-envelope and geotechnical covenants, wildfire covenant and Resort Associations Act notation with qualified advisors.
  • Building feasibility: assess slope, building envelope, design approval, development and building permits, geotechnical sign-off, access, drainage, services and construction costs.
  • Rental plans: review RS-1A zoning and the restriction that tourist accommodation is limited to one dwelling, then verify current licensing, registration, taxation, insurance and operating rules.
  • Landscaping deposit obligation: account for the approved landscaping plan, one-year completion requirement and refundable $20,000 payment required on closing as security.
  • Ownership costs: budget for purchase costs, GST if applicable, legal fees, financing, design, permits, development cost changes, geotechnical work, service connections, construction, landscaping, insurance, utilities, maintenance and property taxes.

About the Information Statement: The December 22, 2023 document states that it is an Information Statement, not a Disclosure Statement, and that purchasers may not rely on a provision unless it is expressly incorporated into the Agreement of Purchase and Sale.
